23rd November 2024, Jabalpur — Centre for Advocacy, Practice, and Research in Intellectual Property (CAPRIP) at Dharmashastra National Law University (DNLU), Jabalpur, organized two impactful events focusing on intellectual property and indigenous rights.
Seminar on ‘Revisiting the Indian Trade Secret Legislation Requirement'
The day began with a half-day seminar addressing the pressing need for a robust trade secret legal framework in India. The seminar opened with a welcome address by Hon’ble Vice Chancellor, Prof. (Dr.) Manoj Sinha. Experts from leading academic and legal institutions shared their insights:
- Prof. (Dr.) Anindya Sircar, DPIIT Chair and Professor at NALSAR University of Law, Hyderabad, highlighted the industrial perspectives for trade secrets in India.
- Prof. (Dr.) Ghayur Alam, DPIIT Chair and Professor at NLIU Bhopal, elaborated on best practices for trade secrets in India and other countries.
- Mr. Amit Dubey, Advocate at Madhya Pradesh High Court, discussed trade secrets from a legal practitioner’s viewpoint.
- Dr. Gargi Chakrabarti, Associate Professor, DNLU, provided a comparative analysis of trade secrets and patents, emphasizing India’s current position and future needs.
Dr. Shruti Nandwana, Assistant Professor at DNLU, moderated the seminar, ensuring engaging discussions throughout. The event concluded with the announcement that a report summarizing the deliberations would be sent to the Law Commission of India to support the development of India’s trade secrets legal regime.
Capacity Building Program on Traditional Knowledge and Genetic Resources
In the afternoon, DNLU hosted a Capacity Building Program on Traditional Knowledge and Genetic Resources Protection in Madhya Pradesh, jointly organized by CAPRIP and the Centre for Studies in Tribal and Indigenous Communities (CSTIC).
The program aimed to bridge the gap between tribal communities and legal frameworks, focusing on the Biological Diversity Act (BDA), 2002. Key participants and resource persons included:
- Prof. (Dr.) Saba F. Hussain, People’s University, Bhopal,
- Dr. Saurabh Maru,
- Mrs. Nandini Maravi, Former MLA, Sihora,
- Mrs. Urmila Bharti, Member, Tribal Advisory Council,
- Representatives from various tribal communities.
Through interactive sessions, the program explored the ground realities of traditional knowledge preservation and shared insights on legal frameworks protecting biodiversity. Resource persons emphasized the importance of spreading awareness about the BDA and its implementation among tribal communities.
Bridging the Gap Between Policy and Practice
Both events succeeded in addressing critical gaps in India’s intellectual property protection regime. While the seminar focused on trade secrets and their industrial and legal significance, the capacity-building program empowered tribal communities by raising awareness about their rights and responsibilities under existing laws.
