Concept Note

Traditionally, the post-adjudicative phase has been considered by the doctrine from the perspective of the creditor State and enforcement mechanisms available to that State in order to determine how to get the other State party to the dispute to comply with an international judgment. A whole aspect of the post-adjudicative phase in international cases involving a State as a defendant remained partly or completely unexplored for decades.

The purpose of the webinar is to propose a perspective change and to provide a complimentary analysis to the traditional analysis of the post-adjudicative phase focused on the enforcement of international judgments, decisions, and awards in cases involving States as defendants.

The proposed perspective is as to take the debtor State, obliged to implement a decision, as the starting point of the analysis, i.e., the State which did not succeed in the proceedings and has obligations “to do”, “refrain from” defined in the international award, decision or judgment: What are the legal principles regulating the post-adjudicative phase? What are the legal hurdles/issues encountered by states in their domestic order when implementing international obligations arising from an international award, decision or judgment?

Speaker’s Profile

Dr Affef Ben Mansour’s practice focuses on Public International Law, European Law, International Investment Arbitration and Commercial Arbitration. Dr Mansour sits also as arbitrator and is a member of the ICC International Court of Arbitration (Tunisia).

She has also been a teaching researcher at Paris Ouest Nanterre La Defense University, where she completed a Doctorate in Public International Law, with honours in 2009 and a DEA in Law of International and European Economic Relations, with honours in 2000 from Paris Ouest Nanterre La Défense University.

Dr Ben Mansour continues her research and teaching activities as an Associate Researcher of the CEDIN (Public International Law Center of Paris Ouest Nanterre La Defense University) and a member of the French Society of International Law and the French Branch of the International Law Association.

She published her thesis on The Implementation of International Judgments and Awards of International Tribunals in 2011. She also regularly publishes on Public International Law, European Law and gives lectures on various topics related to public international law, European law and International Arbitration. Dr Ben Mansour has been appointed member of the ICC Task Force “Addressing Issues of Corruption in International Arbitration”.

She is also an Arbitral Women Board director since June 2018. Her working languages are French (native), Arabic and English. She also reads and understands documents in Spanish and Italian. Dr Ben Mansour is French-Tunisian.
