Part I: English

Question 1

Read the following passage carefully and make a precise by giving a suitable title also. [12 Marks]

The great advantage of early rising is the good start, it gives us in our day's work. The early riser finishes a large amount of work before other men have out of bed. In the early morning, the mind is fresh and there are few sounds or other distractions so that the work done at this time is generally well done. In many cases, the early riser also finds time to take some exercise in the fresh morning air and this exercise supplies him with a fund of energy that will last until the evening. By beginning so early the early riser knows that he has plenty of time to do his work and is not, therefore tempted to do anything in hurry. He goes to sleep several hours before mid-night at the time. When the sleep is most refreshing and after a night's sound rest rise early next morning in good health.

Translate the following into English:[12 Marks]

किसी कार्य को करने या उससे प्रविरत रहने की रजामन्दी आचरण द्वारा भी की जा सकती है। आशय प्रकट करने के लिए शब्द ही एकमात्र तरीका नहीं हैं। आचरण द्वारा भी किसी वचन को या बचन के लिए सहमति को उतना ही स्पष्ट किया जा सकता है, जितना शब्दों द्वारा। प्रस्थापना तथा उसके प्रतिग्रहण का कोई विशेष प्रारूप आवश्यक नहीं है, और न ही संविदा-विधि या माल-विक्रय विधि यह अनिवार्य करती है कि पक्षकारों की सहमति लिखित ही हो। पक्षकारों के आचरण से संविदा के लिए सहमति का परिणाम मिल सकता है और ऐसे आचरण में कार्य या लोप शामिल होगा ।

Write a paraphrase of the following: [12 Marks]

If the people who are elected are capable and men of character and integrity. then they would be able to make the best ever of a defective constitution. If they are lacking in these, the constitution can not help the country. After all, a constitution like a machine is a lifeless thing. It acquires life because of the men who control it and operate it, and India needs today nothing more than a set of honest men who will have the interest of the country before them. It requires men of strong character, men of vision, men who will not sacrifice the interests of the country at large for the sake of smaller groups and areas. We can only hope that the country will throw up such men in abundance.

अब यह स्पष्ट रूप से मान्य है कि मूलाधिकारों एवं राज्य के नीति-निर्देशक तत्वों के बीच अंतर है। मूलाधिकारों का प्रमुख उद्देश्य राज्य की मनमानी शक्तियों के विरुद्ध नागरिकों को संरक्षण प्रदान करना है। मूलतः मूलाधिकारों की प्रकृति सिविल एवं राजनीतिक अधिकारों से जुड़ी रही है। वहीं दूसरी ओर राज्य के नीति-निर्देशक तत्वों का मूल उद्देश्य नागरिकों को सामाजिक एवं आर्थिक दृष्टि से संरक्षण प्रदान करना है। इसके अन्तर्गत राज्य की भूमिका एक अभिमापक के समान है। यद्यपि कि राज्य इन्हें प्राप्त करने के लिए बाह्य नहीं है परन्तु इन्हें लागू किए बिना संविधान की उद्देश्यिका में वर्णित लक्ष्यों को प्राप्त नहीं किया जा सकता । नीति-निर्देशक तत्वों को न्यायालयों द्वारा अप्रवर्तनीय बनाया गया है, जिसका प्रमुख कारण यह था कि संविधान-निर्माता राज्य को पर्याप्त छूट देना चाहते थे जिससे कि वह इन तत्वों को अपनी आर्थिक क्षमता के आधार पर लागू कर सकें। सर्वोच्च न्यायालय ने अपने अनेक निर्णयों में यह अभिनिर्धारित किया है कि मूलाधिकारों एवं नीति-निर्देशक तत्वों के बीच सामंजस्य संविधान का मूल ढाँचा है जिसे संशोधित नहीं किया जा सकता।

निम्नलिखित का हिन्दी में अनुवाद कीजिए: [12 Marks]

A criminal act may be committed by a person of his own accord or on the suggestions of another. The person who suggests the commission of a crime called an Abetor or under English Law an accessary. A criminal act may be committed by the person himself or in conjunction with others. If a person commits it himself, he is known as the actual offender, who is called under English Law a 'principal' in the first degree if he is committed it in conjunction with others, the other participators are known as accomplices distinguished as principals in second degree.

निम्नलिखित का भावानुवाद लिखिए। [12 Marks]

दण्ड विधि के महत्व को भली-भाँति समझने के लिए अपराधशास्त्रदशरथाविधि के परम्पर सम्बन्धों का विवेचन करना उचित होगा। ये तीनों ही विज्ञान के अविछिन्न अंग होने के कारण एक- दूसरे से घनिष्ठतः सम्बन्धित है।का निर्धारणकीकृतम्भीरता पर निर्भर करता है। अतः अपराधों की स्थिति का अनुमान दण्डविधि के आधार पर सरलता से लगाया जा सकता है। अपराध और दण्ड-विधि की परिता केवल इस बात से ही सिद्ध हो जाती है कि विधि केवल उन्हीं मारव आवरणों को अपराध मानती है जिनके लिए संहिता में की व्यवस्था है।
