About the Conference

The discipline of Comparative Constitutional Law reflects a dynamic field which has been rapidly evolving in the modern day, owing to a variety of factors. While there is a growing trend of convergence of constitutional principles across different legal systems due to globalisation, the north-south divide has also permeated the sphere. International law instruments have also exerted their influence upon the constitutional systems and trans-judicial communication and constitutional borrowing are predominant. Further, there are significant shifts in the understanding of the core principles of constitutionalism itself, such as the public-private divide, the status of socio-economic rights, rise of activist judiciaries and new models of separation of powers.

Challenges to constitutional endurance have also grown, raising questions about the need to rethink principles for constitutional design as well as management of external crisis. As the field of comparative constitutional law grapples with these multi-faceted challenges, the methodologies to study the discipline have also been influenced.
