Stolen property is defined in Section 410, Penal Code, as property, the possession of which has been transferred by theft, extortion, or robbery and property which has been criminally misappropriated or in respect of which criminal breach of trust has been committed.

Section 453 of the Code of Criminal Procedure lays down the provision regarding payment to the innocent purchasers of money found on the accused. This section deals only with the money found on the person of the accused at the time of his arrest. It may be utilized in compensating an innocent purchaser of property who loses possession on conviction of the accused.

Further, Section 454 of the code allows Appeal against orders under section 452 or section 453. Sub-section (1) states-

“Any person aggrieved by an order made by a Court under section 452 or section 453, may appeal against it to the Court to which appeals ordinarily lie from convictions by the former Court.”
