Clarifications

• Grace Marks of the Question relating the Section 65B of Evidence Act has been granted for the following reason,

Anvar P.V. v. P.K. Basheer is a case of 2014 in which it was held that documentary evidence by way of an electronic record can be proved only in accordance with the procedure prescribed under Section 65B of the Act. In 2018, in Shafhi Mohammad v. State of Himachal Pradesh, it was held that the requirement of a certificate under Section 65 B (4) is procedural and can be relaxed in the interest of justice provided a party is not in possession of the device. Due to the conflicting position that arose out of the previous two judgments, in 2020, Supreme Court in Arjun P. Khotkar v. Kailash K. Gorantyal & Ors., held that certificate under Section 65B (4) of the Evidence Act is essential for admissibility of electronic records.

• Question relating to Andhra Pradesh formation day is considered for grace marking as the options were not clearly visible to participants.
