In simple words, Suspension means postponement of the execution of the sentence. Section 424 in the Code of Criminal Procedure, 1973 lays down provisions regarding suspension of execution of sentence of imprisonment.
Sub-section (1) empowers the Court to give time, not exceeding thirty days, to an offender who has been sentenced to pay a fine. If the fine is not paid within the time fixed, the Court directs the sentence of imprisonment to be carried into execution. The Court may grant payment by instalments also.
Sub-section (2) states that the provisions of sub-section (1) shall be applicable also in any case in which an order for the payment of money has been made on non-recovery of which imprisonment may be awarded, and the money is not paid forthwith; and, if the person against whom the order has been made, on being required to enter into a bond such as is referred to in that sub-section, fails to do so, the Court may at once pass sentence of imprisonment.
When a Court passes a sentence of the fine upon an accused and in default to suffer imprisonment, the fine is to be paid forthwith, that is to say, on the sentence being pronounced. It is, however, open to a Court to proceed under this section, and if a Court does act under its provisions, it can suspend the execution of the sentence of imprisonment and release the offender on the execution by him of a bond. But it is not mandatory for the Court to do so.
