Amity Law School Chattisgarh is organising National Seminar on Intellectual Property Rights Regime: A Reflection Of Contemporary Society & Economics on Saturday, 10th September 2022.

Concept Note

Intellectual Property Right as the nomenclature suggests it is a right related to 'property' but it is different from the idea of property which is generally understood; first, the property here is not tangible, secondly, this property right is limited only to the extent of 'right to exclude' thirdly, and most significantly it is the outcome of human intellect. The idea of Intellectual Property Rights (hereinafter, IPR) is not singular in its manifestation but refers to a bouquet of eight types. Seven types of IPR namely; copyright, patent, trademark, design, geographical indication, plant variety protection and layout designs of semiconductor integrated circuits are recognised and protected by the legislations enacted by the Parliament whereas the eighth type of IPR; trade secret is recognised by the Court. These rights are limited for they all are territorial, most of them come with a time limitation but a few like trademarks, geographical indications and trade secrets are not bound by time limitations. The IPRs create monopolies which seem to be detrimental to the interests of people but on the other hand they provide encouragement for innovations and development in existing knowledge. The idea of incentivizing the creation of knowledge is the fundamental purpose of IPRs.

The development of science and technology has become conterminous to IPRs and with every passing day a development in technology appears and so the need and issues of such creation of knowledge arises. The latest being the Artificial Intelligence, Internet of Things and Big Data Analytics raises the issues of protection under the existing IPR regimes; what will be the protection, under which category, who will be the owner of such information. What will be status of the knowledge created by the AI and who will be the owner of these IPRs remains a question to be answered.

This National Seminar aims to explore the realm of Intellectual Property at national and international level. It further aims to consolidate the efforts of researchers and students by allowing them to discuss the issues to be resolved and solutions to be adopted in the field of Intellectual Property Rights.

Theme of Seminar

Theme – I: Regimes of Control:

Implications for National and International Regulations The first theme will be focusing on the historical development of the recognition of intellectual property and the development of legal regimes through various international treaties and conventions related to the protection of intellectual property rights and their consequences on the development of domestic legislations. The international conventions to protect intellectual property rights include Paris Convention, the Berne Convention, International Convention for the Protection of Performers, Producers of Phonograms and Broadcasting Organizations (Rome Convention), and the Treaty on Intellectual Property in Respect of Integrated Circuits (IPIC Treaty).

Theme – II: Intellectual Property Rights:

The Indian Experience The second theme will focus on the various Indian legislations related to the protection of intellectual property rights and its impact on the Indian economy and the society at large. The theme will focus on developments of IP regimes in India through various statutes like the Patents Act, 1970, the Trademarks Act, 1999, the Copyright Act, 1957, the Geographical Indications of Goods (Registration And Protection) Act, 1999, the Designs Act, 2000 and the Biological Diversity Act, 2002 but not limited to the mere analysis of statutes but will also include different issues arising in relation to these and the judicial pronouncements thereupon. Some of the issues to be discussed are regarding IP laws in cyberspace, analyzing dimensions of related legislations, patenting of traditional knowledge bases, recognition of plant varieties and their medicinal properties, and international conflicts in the operation of IP laws.

Guidelines for Submission of Paper

Full papers should be prepared in the MS-Word format, Font: Times New Roman, Title of the paper: Font 14, Subtitles: Font 13, Body text: Font 12, Spacing: 1.5 lines, and should not exceed 5,000 words (including footnotes). References must be in the form of footnotes with font size 10 and should be according to the Bluebook 19th edition. The work should be original, previously unpublished and must not be in the stage of submission/ consideration elsewhere. Co-authorship is permissible up to two authors only.
